Process of Trademark Registration
Step 2: Power of Attorney in Case of Foreign Applicants:
If you apply as a foreign applicant, you need to assign a lawyer as your representative to complete the procedure.

DPDT For Trademark Registration
Department of Patents, Designs, and Trademarks (DPDT) govern the trademark registrations in Bangladesh. Any person who claims to be the proprietor of a trademark can send an appeal to the government authority. The applicant has to submit an application for the registration of a trademark to the Trademark Registry Wing of the DPDT.
Document and other necessary requirements for the application
An applicant must provide the following for completing the registration of trademark:

Nationality & Address of the Applicant
Status of the applicant i.e. Manufacturers /Service Providers/ Merchandisers / other
Specification of Goods/Services and Class
Usage date of the mark (the mark is in use or proposed to be used in Bangladesh)
General Power of Attorney. Power of Attorney (POA) may be filed subsequently.
Trademark Registration Process

Search for availability
A prerequisite for applying for trademark registration in Bangladesh it is obligatory to find out whether the trademark is already in use or registered by someone else.
Then after searching, the applicant needs to collect the respective registration form from DPDT and submit it after filling properly.
Acknowledgment of Application
The Registrar, after receiving the application, issues an Official Filing Receipt. The document contains related filing details on the trademark.
After receiving the application registrar scrutinize the trademark for two issues: a) distinctiveness and b) general compliance with the necessities of the Law.
Letter of acceptance
If the submitted application fulfills all the requirements, the Registrar issues a Letter of Acceptance for a mark that needs to be advertised in the Trade Marks Journal for the purpose of receiving opposition. Otherwise, Registry raised objection seeking written reply regarding objections.
Refusal of Application
The application may get refused for several reasons. However, when it happens then the client must submit a reply to the show-cause notice and may seek a hearing in the matter within three months otherwise; the application will be abandoned.
Acceptance of Application
If the examiner appreciates the application and its requirements, the Registrar can accept the mark for advertisement in the Trade Marks Journal.
When a trademark advertisement is done for the opposition in the Trade Mark Journal, any person might provide notice of Opposition to the Registrar on Form TM-5 within two months from the date of the publication.
If no opposition is acknowledged at the expiration of the opposition period or the opposition is determined and then resolved in favor of the Applicant, the Registrar on payment of the prescribed fee is obliged to issue a Certificate of Registration for the trademark.
The authority issues a registration date after the completion of all the procedures. The date of filing of the application is the registration date of the trademark.
The validity duration of Registration
A trademark is legitimate and valid for an initial period of 7 years from the date of filing of the application. After that, it is renewable for successive periods of 10 years.
The total process should not require more than a week or two. But it may often take a longer time than as usual. In DPDT a client needs to fill up everything manually, so sometimes it may take longer.
